But the rule can be suspended by a detective on the case. Although it is now formalized, 'we’ve been handling notifications this way for a long time,' says a source. 'This way it’s now on paper.'

The families of people who are killed by police or die in custody will be notified of the death within two hours, according to new patrol guidelines released by the NYPD.
Under the new rules issued last month, a cop with a rank of lieutenant or higher must alert family members “in a reasonable amount of time, preferably within two hours” of the fatality.

The NYPD is usually the first to alert family members of a police-involved death, but in June 2012, a city councilman had the misfortune of being the first to alert Shantel Davis’ parents that the 23-year-old woman had been shot dead by a Brooklyn cop after she crashed a stolen car and tried to drive away from the East Flatbush smashup.
Davis was unarmed when she was shot and killed, and Councilman Jumaane Williams (D-Brooklyn) got to her family’s home before cops, sources said.

“I am pleased that (the two-hour) rule has been formally codified,” said Councilman Jumaane Williams.

It’s not clear what effect the new rule will have, given that the timetable can be suspended by the detective on the case, the memo states.

The NYPD did not return a request for comment, but a high-ranking police source said the rule was written down to clarify an ongoing practice.
“We’ve been handling notifications this way for a long time,” said the source. “This way it’s now on paper.”
